Epstein Credits Explained

Under In re Marriage of Epstein (1979), a spouse who uses separate funds to pay community debts after the date of separation is entitled to reimbursement from the community.

Reimbursement for Post-Separation Debt Payments

When spouses separate, community bills (credit cards, vehicle loans, utility bills) often continue coming due. Under In re Marriage of Epstein (1979), a spouse who uses post-separation separate earnings to pay down community debts is entitled to reimbursement.

Exceptions Where Epstein Credits Do NOT Apply

  • Where payments were made in lieu of spousal support or child support.
  • Where the paying spouse was using the asset exclusively without paying rent (see Watts charges).
  • Where there was an explicit agreement that the payment was a gift.
